Please read these Terms and Conditions carefully before using the HoTo platform. By accessing or using our services, you agree to be bound by these terms.
1.1
These Terms & Conditions ("Terms") govern your use of the HoTo mobile application, website, platform, services, wallet, and related features (collectively, the "Platform").
1.2
By using HoTo, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, and any additional terms communicated to you.
1.3
The Platform is owned and operated by Hometown Offers Pvt. Ltd. ("Company", "We", "Us", or "Our").
1.4
These Terms apply to: Customers ("Users") who avail discounts, recharge wallet, or purchase offers, and Vendors/Businesses ("Vendors") who list offers on HoTo.
1.5
If you do not agree to these Terms, you must stop using the Platform.
2.1
You must be 18 years or older to use HoTo.
2.2
Vendors must be legally registered businesses in India with a valid GST number, shop license, PAN, or other required regulatory documents.
2.3
The Company reserves the right to verify identity, KYC details, and business documents.
3.1 Customers
Must provide a valid mobile number and OTP verification. Optional: Email ID for communication. Must provide accurate information.
3.2 Vendors
Must complete KYC verification, which may include: Business name & address, Authorized person details, Government-issued ID, GST certificate, Bank account details. Company may reject or suspend an account if documents are invalid or incomplete.
HoTo is a hyperlocal marketplace enabling: Customers to discover nearby businesses and redeem exclusive offers. Vendors to list discounts, offers, and rewards. Customers to make payments using HoTo Wallet, UPI, or other integrated payment options. Vendors to accept payments via QR code. Hoto Points to be awarded based on recharge activity. HoTo is a technology facilitator, not a seller, distributor, reseller, or agent of any Vendor.
5.1 HoTo Wallet
Users may recharge the wallet using UPI, net banking, cards, or other payment methods. Recharges are non-transferable. Wallet cannot be used for cash withdrawals. Wallet balance can only be used on HoTo partner stores.
5.2 HoTo Points
Awarded for wallet recharge or promotional campaigns. Points cannot be converted to cash. Validity of points may vary; expired points cannot be recovered.
5.3 Payments
Example: If Vendor provides 10% offer, Customer pays only 90 using HoTo Wallet. The Vendor receives the agreed settlement value after deducting platform fees (if applicable). All payments are processed through third-party payment gateways.
5.4 Failed Transactions
In case of technical failures, refunds may take 2–7 working days depending on the payment gateway.
6.1
Vendor-controlled: Vendors decide their discounts, offer validity, and availability.
6.2
Offers may change without prior notice.
6.3
HoTo is not responsible for: Quality of products or services, Vendor pricing changes, Refusal of service by Vendor, Miscommunication between Vendor and Customer.
6.4 QR-based Redemption
Customers must scan the Vendor's HoTo QR to redeem discounts. Discounts apply only at partner outlets listed on the Platform.
HoTo is a platform provider and is not responsible for: Quality, safety, legality, or delivery of goods/services by Vendors, Incorrect billing by Vendors, Vendor behavior or staff conduct, Price changes made by Vendors, Disputes regarding product defects or service dissatisfaction. However, HoTo may attempt to mediate disputes only based on platform transaction proof.
Users agree to: Provide accurate account information, Use the Platform only for lawful purposes, Not misuse offers, coupons, or QR codes, Not attempt fraudulent transactions, Not raise false claims or disputes, Respect Vendor terms and store rules, Pay applicable amounts promptly. HoTo may suspend users suspected of fraud.
Vendors must: Honor all offers listed on HoTo during validity, Provide accurate business details and pricing, Ensure product/service quality, Display the HoTo QR prominently at billing counter, Resolve customer complaints related to their service, Not mislead customers with false offers, Settle any disputes directly with the customer when related to their service, Keep business license, FSSAI (if applicable), and GST details valid. Vendors violating rules may be penalized or removed from the Platform.
10.1
Customers may raise tickets through HoTo support.
10.2
HoTo may act as a facilitator between Customer and Vendor.
10.3
HoTo may approach the payment gateway in case of payment failures or wallet issues.
10.4
HoTo is not responsible for disputes related to: Product defect, Poor service, Delay, Price mismatch, Wrong order. These must be resolved between Customer and Vendor.
Wallet recharge is non-refundable unless money is stuck/failed at the payment gateway. Offers purchased cannot be cancelled once redeemed. If a Vendor denies service after a successful transaction, refund decisions will be made on a case-by-case basis. Vendor settlement disputes will be processed as per HoTo's settlement cycle.
12.1
Settlement cycle may be daily/weekly depending on guidelines.

Settlement amount = Collected Amount – Platform fees – Payment gateway charges – Taxes
12.3
Vendor bank details must be correct; HoTo is not responsible for delays caused by incorrect details.
You agree NOT to: Use fake numbers, fake accounts, or proxies, Manipulate rewards or points, Engage in chargeback fraud, Harass Vendors, staff, or other customers, Upload malware or harmful code, Reverse engineer the HoTo app, Copy or misuse HoTo branding, content, or technology, Attempt unauthorized transactions. Account will be terminated if such behavior is detected.
All content on HoTo (logos, code, UI, text, graphics, database, offers) is the property of Hometown Offers Pvt. Ltd. You may not copy, modify, reproduce, or distribute any content without written permission.
Your data is protected as per our Privacy Policy. We may use your data for: Service improvement, Fraud prevention, Location-based offers, Communication about updates/offers. We do not sell personal data to third parties.
HoTo may include third-party integrations such as: Payment gateways, Map providers, Analytics tools. We are not responsible for their policies or actions.
To the maximum extent permitted by law: HoTo is not liable for any service failure or product-related issue by Vendors. HoTo is not liable for loss of profits, reputation, or business. HoTo is not liable for technical errors, downtime, or network failures. HoTo's maximum liability shall be limited to the value of the last transaction made on the Platform.
HoTo may suspend or terminate accounts for: Misuse of platform, Fraud, Violations of these Terms, Chargeback abuse, False complaints, Vendor misconduct, Illegal activity. Users may delete their account anytime by contacting support.
These Terms are governed by the laws of India. Any disputes shall be settled in courts located in Tamil Nadu (Nagapattinam/Chennai).
Users agree to receive: SMS alerts, Transaction notifications, Promotional messages, Email communication. You may opt-out from marketing messages anytime.
HoTo may modify these Terms at any time. Updates will be reflected on the website and app. Continued use of HoTo constitutes acceptance of updated Terms.
